Plaintiff, Mary Hierath-Prout, appeals the trial court's order awarding costs to defendant, Colin Bradley. We affirm.

Plaintiff brought this action claiming that defendant, a co-employee, assaulted and battered her. Defendant moved for summary judgment on the basis that plaintiff's exclusive remedy was pursuant to the Colorado Workers' Compensation Act, § 8-40-101, et seq., C.R.S.1998.
