Memorandum:

Defendant was convicted of murder in the second degree (Penal Law § 125.25 [1]) for intentionally causing the death of a woman whom he had picked up at a bar. After the victim's body was found, defendant, who was the last person seen with the victim, told a friend that he and the victim had been kidnapped. Defendant told another person, however, that the victim got out of his car when he stopped at a minimart...
