In May 1997, Nita Kelly and her husband Neal Kelly sued Lynda H. Estabrook, alleging that Estabrook had negligently and/or wantonly caused her automobile to collide with an automobile driven by Mrs. Kelly. The Kellys requested compensatory damages for Mrs. Kelly's medical expenses and pain and suffering, and for Mr. Kelly's loss of consortium. The case proceeded to a jury trial.
