On June 28, 1993, Shantel D. Pender was tried without a jury in the Circuit Court of the City of Petersburg and convicted of first degree murder. After affirmance of the conviction on direct appeal, Pender filed a petition for a writ of habeas corpus with this Court pursuant to Code § 8.01-654, claiming that he was denied his rights under the Sixth Amendment to the United States Constitution because his trial counsel was ineffective.
