In November of 1995, Fernando Perez was convicted of murder. See TEX. PEN. CODE ANN. § 19.02(b) (Vernon 1994). Perez appealed his conviction, complaining that the court erred in refusing to charge the jury in its punishment charge on the issue of sudden passion. We remanded the cause for a new punishment hearing. See Perez v. State,
