In November of 1995, Fernando Perez was convicted of murder. See TEX. PEN. CODE ANN. § 19.02(b) (Vernon 1994). Perez appealed his conviction, complaining that the court erred in refusing to charge the jury in its punishment charge on the issue of sudden passion.
