Petitioner seeks review of a decision by the Land Use Board of Appeals (LUBA) in which LUBA upheld a decision by the City of Gates to deny petitioner a building permit for a billboard sign structure. Petitioner contends that the city interpreted its zoning code in a manner that violated its right to free expression under Article 1, section 8, of the Oregon Constitution and the First Amendment to the United States Constitution.1
