Memorandum:

Defendant appeals from a judgment convicting him of manslaughter in the first degree (Penal Law § 125.20 [1]) as a lesser included offense of intentional murder, and criminal possession of a weapon in the third degree (Penal Law § 265.02 [1]). Defendant was sentenced to concurrent terms of incarceration of 12½ to 25 years and 2 1/3 to 7 years.
