After an evening of heavy drinking, a verbal dispute erupted between Shane Moelder (hereinafter the victim), on the one side, and defendant and Mark McLain, on the other. McLain and the victim, who was extremely intoxicated, decided to take the dispute out onto the front porch of the victim's apartment.
