Petitioner's employment as a psychologist with the Bronx Developmental Services (hereinafter BDS) terminated on July 27, 1990 following an accident at his home where he sustained head injuries. On September 13, 1993, Marsha Grossman, petitioner's wife, acting under a power of attorney, filed an application with respondent New York State Employees' Retirement System for ordinary disability retirement benefits.
