The defendant, James S. Ellis, was charged by bill of information with aggravated assault with a firearm, a violation of LSA-R.S. 14:37.2.1 He pled not guilty and, after trial by jury, was found guilty as charged. He subsequently was sentenced to five years at hard labor. The court suspended three years of the sentence and placed the defendant on probation for three years with a number of special conditions.
