The Town of Berthoud (Berthoud) appeals the summary judgment granted in favor of the Town of Johnstown (Johnstown) and the judgment awarding Johnstown costs. We affirm.

This action arises from Johnstown's annexation of five parcels of land which extended Johnstown's southern boundary over two miles south to the Berthoud exit on Interstate 25. One petition for annexation encompassing all five parcels was filed in November 1996....
