¶ 1. In 1994 David Earl McCaleb pled guilty to two counts of the unlawful sale of a controlled substance. In 1998 he filed a petition for relief under the Uniform Post Conviction Collateral Relief Act. The grounds alleged were that he was denied effective assistance of counsel due to his attorney's failure to disclose a conflict of interest and his failure to object to the indictment on double jeopardy grounds.
