In March 1997, an indictment charged defendant with the crimes of assault in the first degree, reckless endangerment in the first degree and endangering the welfare of a child after he allegedly squeezed the rib cage of his three-month-old son fracturing bones and causing injuries. Defendant subsequently made an omnibus motion to, inter alia, dismiss the indictment on the ground that the charges were not supported by legally sufficient evidence...
