Appellant, Carlton Palms Hotel, Inc. ("Carlton Palms") signed a contract for mortgage brokerage services with appellee, Fidelity Trust, Inc. ("Fidelity"). The day the contract was signed, Fidelity delivered a mortgage loan commitment to Carlton Palms, which ultimately never closed the loan.
