STATEMENT THE CASE

On October 3, 1991, the State filed a bill of information charging the defendant, Alton Cureaux, with possession of cocaine with intent to distribute. At his arraignment he entered a not guilty plea. His first trial, held on March 17, 1992, ended in a mistrial when the jury was unable to reach a verdict. The defendant was retried on August 17, 1992, and a twelve-member jury found him guilty of attempted possession...
