Tina Mizwicki ("Mizwicki") filed suit against two defendants under Title VII of the Civil Rights Act of 1964 for alleged sexual harassment which she claims resulted in her constructive discharge. At the close of her case in chief, the district court granted defendants' motion for judgment as a matter of law, finding that Mizwicki presented insufficient evidence that either defendant was an "employer" as Title VII defines that term.
