This interesting case explores the meaning of "fair value" under the Nebraska Dissenters' Rights law. Neb.Rev.Stat. Ann. § 21-20,137, et seq. (Michie 1999). After a well-tried nonjury trial by excellent lawyers for both sides, I conclude that the defendants did not receive "fair value" for their shares. Accordingly, judgment will be entered for the defendants...
