Defendant, Alfred Houston, an inmate at Louisiana State Penitentiary at Angola, was charged by grand jury indictment with attempted first degree murder, a violation of LSA-R.S. 14:27 and 30. He pled not guilty. After a trial the jury returned the responsive verdict of attempted second degree murder, a violation of LSA-R.S. 14:27 and 30.1. Defendant filed a motion for post verdict judgment of acquittal, which was denied. The trial court sentenced defendant...
