OPINION

WEISBERGER, Chief Justice.

This case comes before us on the appeal of the plaintiff, Carol B. Folan, from a motion to dismiss for failure to state a claim upon which relief can be granted entered in favor of the defendants. We reverse the judgment of the Superior Court. The facts insofar as pertinent to this appeal are as follows.
