BACKGROUND

Joseph W. Alcaraz, along with three other individuals, was charged by information on July 1, 1996, with first degree forcible sexual assault. Both Alcaraz and the State allege that this charge was amended to first degree sexual assault approximately 2 years later, although the record does not contain an amended information.
