STATEMENT OF THE CASE

Harold E. Slutsky appeals the trial court's entry of summary judgment in favor of James Don Crews and Gibson Insurance Agency, Inc. (collectively "Crews and Gibson"). Slutsky filed suit against Crews and Gibson alleging negligence, breach of fiduciary duty and constructive fraud.
