This case is yet another reminder that litigants who try again after losing in state court are likely to encounter the doctrines of claim preclusion, issue preclusion or both. In 1988, Walsh Construction Company of Illinois built a 279-unit apartment complex in Lombard, Illinois. After a severe thunderstorm in October 1990, water leaked into the complex and damaged several units. Walsh notified its insurer, National Union Fire Insurance Company...
