ALMON, Justice.

Roger Dale Frazier was arrested and subsequently indicted for two counts of first-degree robbery in violation of Ala. Code 1975, § 13A-8-41. On one count, the jury convicted him of first-degree robbery and on the other count it convicted him of the lesser-included offense of second-degree robbery. See Ala.Code 1975, § 13A-8-42. The circuit court sentenced Frazier under the Habitual Felony Offender Act to life imprisonment without parole on...
