I. INTRODUCTION

A four-million-dollar powerline construction project gone awry spawned two generations of litigation. The first, a suit by the general contractor, Power Constructors, Inc. (PCI), against the project engineer and project designer, languished in court for three years, died for lack of prosecution, and was laid to rest in Power Constructors, Inc. v. Acres American, 811 P.2d 1052
