The defendant below, appellant, Johnny Rodoussakis, was charged with felony murder in violation of W.Va.Code § 61-2-1 (1991) in the June 22, 1996 death of Randall Burge. Following a jury trial July 28, 1997 through July 31, 1997 in the Circuit Court of Raleigh County, West Virginia, the defendant was found guilty with no recommendation of mercy.
