Plaintiff Bennie Cunningham originally filed a claim on May 15, 1995, alleging that his civil rights were violated by several unnamed deputy U.S. Marshals while he was a prisoner of the State of Illinois and that he was entitled to relief under 42 U.S.C. § 1983. He amended this claim to name the marshals individually on February 5, 1997. The named marshals now move to dismiss Cunningham's claim...
