SAUNDERS, Judge.

The State of Louisiana through the Department of Transportation and Development (DOTD) appeals a jury verdict in favor of appellee, assessing DOTD with 90% of the fault in causing the motor vehicle accident which led to plaintiff's back injuries. The DOTD also contests the plaintiff's entitlement to special damages, as well as the trial judge's JNOV in favor of plaintiff increasing the general damages awarded by the jury.
