Marable, was convicted in the Superior Court of distribution of cocaine, possession of marihuana with intent to distribute, and distribution of a controlled substance within 1,000 feet of a school zone. He appealed, arguing that the indictments should have been dismissed because the Commonwealth failed to bring him to trial within one year of his arraignment as required by Mass. R. Crim.
