This case presents the question of whether two claims made by the plaintiff are timely. According to the defendant, these claims were first made in a brief filed some two and one-half years after plaintiff's last amendment to his complaint. Under the applicable statute of limitations, these claims would be timely only if they could be set forth in an amended pleading that would relate back to the original complaint.
