On appeal, defendant contests only County Court's determination denying his pretrial motion to dismiss the indictment based upon the People's failure to provide him with notice of the pendency of Grand Jury proceedings and of his right to appear before the Grand Jury as a witness on his own behalf (see, CPL 190.50 [5] [a]).
