THAYER, J.

The defendant, Daniel Liakos, brings an interlocutory appeal from a ruling of the Superior Court (Mohl, J.), see SUP. CT. R. 8, denying his motion to dismiss a negligent homicide indictment. RSA 630:3, I (1996). The defendant argues that retrial of this indictment is barred by the Double Jeopardy Clause of the State Constitution. We affirm and remand.
