This is an appeal of an order of summary judgment entered by the district court in favor of the Intervenor Plaintiff-Appellee, the Federal Deposit Insurance Corporation ("FDIC"). Certain lands owned by the FDIC's ancestor-in-title were sold at a tax sale before the FDIC was named receiver. The FDIC wished to set the sales aside. The district court found that the FDIC did not consent to foreclosure...
