Before the court is the motion of the plaintiff Trilogy Communications, Inc., (hereinafter "Trilogy") for judgment as a matter of law with regard to the defendants' state law counterclaims of malicious prosecution and unfair competition. Brought on day two in a jury trial between the parties, after defendants had rested on their case-in-chief, Trilogy's motion is governed by Rule 501
