This matter is before the Court on the Defendant's Motion to Dismiss. This motion was originally before the Magistrate Judge. After the Plaintiff failed to timely respond to the Defendant's motion, the Magistrate Judge recommended that the Defendant's motion be granted and Count II of the Complaint consequently be dismissed with prejudice.
