TOMLJANOVICH, Justice.

Respondent Melissa Gleason is physically disabled. She suffers from a form of muscular dystrophy known as muscular atrophy, and is confined to a wheelchair. Gleason sued the Metropolitan Council Transit Operations ("MCTO"), the bus driver and a supervisor alleging disability discrimination and various torts arising from an incident when she boarded a bus on December 2, 1995.
