STATEMENT OF THE CASE

In July of 1995, Lee O. Brown filed his Complaint for Damages against Charles Figures, an uninsured motorist, and Allstate Indemnity Company ("Allstate"), Brown's insurer. The complaint was subsequently amended. Allstate filed answers to both the original and amended complaint.
