Plaintiff-Appellant City of Hobbs sued Nutmeg Insurance Company (Nutmeg) in New Mexico state court alleging bad faith, breach of contract, and unfair claims practices in defense of a federal court damage claim brought earlier under 42 U.S.C. § 1983 and a supplemental wrongful death claim against Hobbs and Officer Harrison of the Hobbs police force. Nutmeg removed the state court action for bad faith and related claims to the United States...
