Ordered that the order is reversed insofar as appealed from, on the law, with one bill of costs, the cross motions of the defendant and third-party defendant for summary judgment are denied, the complaint and third-party complaint are reinstated, and that branch of the appellant's cross motion which was for leave to conduct further discovery is granted.
