The two-count indictment in this case charges defendants Nieves and Cofie with conspiracy to distribute and possess with intent to distribute heroin, in violation of 18 U.S.C. § 846, and possession with intent to distribute heroin, in violation of 21 U.S.C. § 841(a)(1). Each defendant has moved to suppress physical evidence, including, inter alia, 90 grams of heroin, cutting agents and packaging material...
