Defendants have filed a joint motion to dismiss plaintiff's complaint pursuant to Fed. R.Civ.P. 12(b)(1)1 and (6) or in the alternative to stay proceedings pending the outcome of an underlying state court matter.2 For the reasons set forth below, the motion is denied.
