Appellants, the Mifflin Group, Phillip Eckert, Nancy Fanello, and David Braeunig, appeal the decision of the Ashland County Court of Common Pleas that sustained a motion for summary judgment/motion to dismiss filed by appellees, Muskingum Watershed Conservancy District and Johnny Appleseed Heritage Center, Inc. ("Johnny Appleseed"). The following facts give rise to this appeal.
