The National Labor Relations Board ("the Board") has appealed from a district court's denial of its request to order the Midland Daily News ("Midland"), a general circulation newspaper published in Midland, Michigan, to comply with a subpoena duces tecum. The subpoena sought the production of documents that identified the source of an "anonymous" advertisement in the newspaper's classified pages...
