Gilbert Levi Phillips fled North Dakota to evade prosecution for felony theft of property. Phillips was subsequently arrested in Minnesota, where he was informed that North Dakota sought his extradition. Phillips challenged extradition, thereby requiring that a governor's rendition warrant be issued for his arrest.
