The petitioner, a citizen of Guatemala, came to the United States in 1989 on a visitor's visa. Wanting to remain, he made a sham marriage with an American citizen and applied for permanent residency in the United States. The nature of the marriage was discovered, and his application for permanent residency denied. He then petitioned for political asylum and withholding of deportation.
