Inco Alloys International (hereinafter "Appellant" or "Inco") appeals a May 23, 1996, decision of the Circuit Court of Cabell County denying Inco the right to a subrogation lien upon a settlement amount received in a civil action filed by Cecil William Cart, II, (hereinafter "Appellee"). The Appellant contends that the lower court erroneously deprived it of the right to the subrogation lien. We agree and reverse the decision...
