MEMORANDUM OPINION AND ORDER

KEELEY, District Judge.

Currently before the Court is the defendant's Motion to Dismiss, filed on June 22, 1998. After careful consideration of the defendant's arguments and the plaintiff's response, the Court GRANTS the Motion to Dismiss pursuant to Rule 12(b)(1) and Rule 12(b)(6) of the Federal Rules of Civil Procedure.
