FLETCHER, Presiding Justice.

A jury convicted David Perkins of the murder of Herbert D. Ryals, III, and he was sentenced to death.1 The jury found as aggravating circumstances that the murder was committed while the defendant was engaged in the commission of an aggravated battery and was outrageously and wantonly vile, horrible, and inhuman in that it involved depravity of mind and an aggravated battery to the victim.
