On January 31, 1994, Plaintiff Hyosung America, Inc. ("Hyosung") commenced this action, asserting nine claims against defendant Sumagh Textile Co., Ltd. ("Sumagh"). Defendant, in turn, asserted conterclaims for breach of contract, quantum meruit, and unjust enrichment. On November 13, 1995, defendant moved for summary judgment against Hyosung's nine claims.
