This appeal arises from a grant of summary judgment in favor of Amica Mutual Insurance Company ("Amica") in a declaratory judgment action wherein Amica sought and received a declaration of non-liability for the actions of Jong Franklin under two of Amica's policies which provided coverage to its insured Louis Forgione.
