Plaintiff James DeBitetto commenced this action against the Alpha Books division of Simon & Schuster ("Simon & Schuster") and Sarah Hodgson, asserting claims for breach of contract; copyright infringement, 17 U.S.C. § 101 et seq.; and violation of the Lanham Act, 15 U.S.C. § 1125(a).1 DeBitetto
